Terms applicable to the use of Versatik services (Busony)

1. Purpose
These general terms and conditions (T&C) govern the use of services provided by Busony, company publishing conversational artificial intelligence solutions (voicebot and chatbot) accessible at versatik.net.
Versatik is Busony's commercial brand for its AI agent solutions.
Any order implies unconditional acceptance of these T&C.
2. Service Description
Versatik offers intelligent virtual assistant solutions in the form of:
- Chatbot : Conversational chat assistant for your website
- Voicebot : Voice assistant for telephone call management
- Combo : Solution combining chatbot and voicebot
Services are provided according to different subscription plans (Starter, Pro, Premium) with allocated monthly credit volumes.
3. Order and Subscription
Subscription to a plan is done online on our platform. The customer must:
- Create a user account
- Select a subscription plan
- Accept these T&C
- Proceed with payment via our secure system (Stripe)
The order is confirmed by sending a confirmation email containing the subscription summary.
4. Pricing and Payment
Prices are indicated in euros (€) excluding taxes. The total amount including tax is specified before order validation.
Payment terms:
- Credit card payment via Stripe (PCI-DSS secured)
- Automatic monthly direct debit for recurring subscriptions
- Billing at the beginning of each subscription period
In case of payment default, access to services may be suspended until regularization.
5. Duration and Renewal
Subscriptions are taken out for a duration of one month, automatically renewable. The customer can cancel their subscription at any time from their personal account.
Cancellation takes effect at the end of the current period. No pro-rata refund is made for the period already paid.
6. Credit System
Each subscription plan includes a monthly credit volume:
- 1 credit = 1 second of voicebot usage
- 1 credit = 1 chatbot message
- Unused credits are not carried over to the following month
- Additional credits can be purchased at any time
7. Customer Obligations
The customer undertakes to:
- Provide accurate information during registration
- Use the services in accordance with their intended purpose
- Not attempt to circumvent technical limitations
- Comply with applicable laws and regulations
- Maintain the confidentiality of their login credentials
8. Responsibilities and Warranties
Busony undertakes to provide services with diligence and according to industry standards. However:
- Busony does not guarantee 100% availability of services
- Busony's liability is limited to direct and foreseeable damages
- The customer is responsible for the content they configure in their assistants
- Busony cannot be held responsible for the customer's use of the services
An availability target of 99% is aimed for, excluding scheduled maintenance.
9. Intellectual Property
All elements of the Versatik platform (software, text, images, design) are protected by copyright and remain the exclusive property of Busony. The customer only has a right of use within the scope of their subscription.
10. Personal Data Protection and Role of Parties
When the Versatik platform is used by the customer to process data from their own customers (patients, end customers, etc.), the customer is the data controller within the meaning of GDPR. Busony acts as a processor, in accordance with Article 28 of GDPR.
The customer undertakes to inform data subjects of the use of a conversational assistant (chatbot / voicebot) and the processing of their data via Busony, and to keep their own privacy policy updated accordingly.
Busony undertakes to process personal data of the customer's end customers only on documented instructions from the latter and for the sole purposes of providing the service (call management, conversations and appointments, messages and usage statistics).
11. Data Processing Agreement (DPA)
These T&C, supplemented by the Privacy Policy constitute the data processing agreement between the customer (data controller) and Busony (processor) within the meaning of Article 28 of GDPR.
Busony implements appropriate technical and organizational measures to ensure a level of security adapted to the risk (flow encryption, access control, logging, backups, EU hosting, etc.).
The customer authorizes Busony to use the following sub-processors for service execution:
- Supabase (database hosting, EU)
- DigitalOcean (web infrastructure, EU)
- Stripe (payment)
- AI providers (voice recognition/synthesis, LLM): OpenAI, Google AI, etc.
Busony informs the customer of any substantial changes to this list via Privacy Policy updates.
At the end of the contract, Busony undertakes to delete or return all personal data processed on behalf of the customer, unless otherwise required by law.
12. Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the customer has a period of 14 days from subscription to exercise their right of withdrawal.
However, if services are used during this period, the right of withdrawal can no longer be exercised.
13. T&C Modifications
Busony reserves the right to modify these T&C at any time. Customers will be informed by email of any substantial changes. Continued use of the services after notification constitutes acceptance of the new conditions.
14. Applicable Law and Jurisdiction
These T&C are subject to French law. In case of dispute, and after attempted amicable resolution, French courts shall have sole jurisdiction.
